This Service Agreement ("Agreement") is entered into as of the date of booking by and between the client utilizing the Tabi platform operated by GEM Co., Ltd (hereinafter referred to as "Client") and the vehicle owner (hereinafter referred to as "Lender"). GEM Co., Ltd shall act solely as an intermediary facilitating various experiences, including but not limited to car sharing, helicopter and private jet bookings, and guided tours.

 

1. Purpose

The purpose of this Agreement is to delineate the terms and conditions under which the Client shall engage in the diverse experiences offered by GEM Co., Ltd, including the utilization of luxury vehicles, helicopters, and private jets, as well as the opportunity to explore Japan with a bilingual guide.

 

2. Experience Use

The services and experiences provided by GEM Co., Ltd may include, but are not limited to, car sharing, luxury vehicle rides, helicopter and private jet bookings, and guided tours. Clients may participate in such experiences as drivers or passengers. The Client agrees to comply with all applicable safety regulations and guidelines and to report any incidents immediately to GEM Co., Ltd.

 

3. Self-Driving Experience

In the event that the Client books a self-driving experience, the Client shall receive a car-sharing agreement which must be duly completed and returned to GEM Co., Ltd no less than 48 hours prior to the scheduled booking, whenever feasible. Failure to complete and return the agreement may result in the cancellation of the booking. The Client must possess a valid Japanese driving license or a valid international driving license that authorizes driving in Japan. Additionally, all Clients opting for self-driving experiences must be at least 26 years of age. Such documentation must be submitted to Tabi along with the completed car-sharing rental agreement. GEM Co., Ltd shall review the submitted documents, and upon authorization, the Client will receive permission to drive. GEM Co., Ltd reserves the right to reject any booking at its sole discretion.

 

4. Risks and Liability

The Client acknowledges and agrees that participation in the experiences provided by GEM Co., Ltd is undertaken at the Client's own risk. GEM Co., Ltd shall not be liable for any injuries, damages, or losses incurred by the Client or their property during the course of any experiences.

 

5. Fees and Payment

By confirming the booking, the Client agrees to the fees specified on the Tabi website, which may encompass a one-time lump sum rental payment and an additional deposit intended to cover potential damages, as detailed in the vehicle's listing.

 

6. Client Responsibilities

The Client agrees to:  

- Utilize the services in a responsible and lawful manner.  

- Promptly report any damages or incidents to GEM Co., Ltd.

 

7. Insurance

The Lender shall ensure that all Clients are provided with appropriate insurance coverage for the vehicle. Clients shall not be required to procure their own car insurance.

 

8. Indemnification

The Client hereby agrees to indemnify and hold harmless GEM Co., Ltd and the Lender from any and all claims, damages, or liabilities arising from the Client’s participation in the experiences provided.

 

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Japan.
